1. Acceptance of the terms

These Terms and Conditions (hereinafter, "Terms") govern the use of the TurisOnRoad website and the services offered through it. Use of the website confers the status of User and implies full and unreserved acceptance of all the Terms established herein.

The User undertakes to read these Terms carefully each time they access the website, as they may be subject to modifications. If you do not agree with any of the Terms, you must refrain from using the website and the services offered.

2. Purpose and description of the service

TurisOnRoad is a website aimed at providing tourism information, including, among others, recommendations of places to visit, experiences, accommodation, gas stations, content on motorhome tourism, wines, Camino de Santiago and other resources related to road tourism.

Access to the website is free and free of charge. However, certain functionalities may require prior registration by the User or the contracting of additional services.

3. User registration

To access certain functionalities of the website (such as leaving comments, marking favourites, managing personal lists or enjoying the advantages of the TurisOnRoad Card), the User must register by providing the data requested in the registration form.

Registration conditions

• The User declares to be over 14 years old. Otherwise, they must have the express consent of their parents or legal guardians.
• The User guarantees the truthfulness, accuracy and updating of the data provided, being solely responsible for false or inaccurate statements and for any damage that this may cause to the Owner or third parties.
• The User undertakes to maintain the confidentiality of their access credentials (username and password) and not to transfer them to third parties. They will be responsible for all actions carried out from their account.
• The User shall immediately notify the Owner of any unauthorised use of their account or any security breach of which they become aware.
• Each User may have a single personal account. The creation of multiple accounts or the transfer of the account to another person is not permitted.

Account cancellation

The User may request the cancellation of their account at any time by sending a request to the email address info@turisonroad.com. The cancellation will involve the deletion or anonymisation of their personal data, without prejudice to the conservation of those data legally required or necessary to address possible claims.

4. User obligations

The User undertakes to use the website and its services in accordance with the law, morality, good customs and public order, as well as with the provisions of these Terms. In particular, the User undertakes to:

• Not use the website for unlawful, fraudulent purposes or harmful to the rights and interests of the Owner or third parties.
• Not introduce, store or disseminate through the website any defamatory, insulting, obscene, threatening, xenophobic content that incites violence, discrimination or that, in general, attacks the dignity of persons or fundamental rights.
• Not introduce, store or disseminate programs, viruses, computer code or any element likely to cause damage to the website, the Owner's systems or those of third parties.
• Not engage in spam practices, unsolicited mass mailings, nor use the website for unauthorised advertising or commercial purposes.
• Not use techniques of mass data extraction (scraping) or any automated system to access, obtain or reproduce the content of the website without the express authorisation of the Owner.
• Respect the intellectual and industrial property rights of the Owner and third parties.

5. Content published by users

The website may allow registered Users to publish comments, ratings, photographs or other content about the experiences, accommodation or places shown (hereinafter, "User Content").

User responsibility

The User is solely responsible for the User Content they publish, guaranteeing that:

• It is of their authorship or they have the necessary rights and authorisations for its publication.
• It does not infringe third-party rights (intellectual property, image, honour, privacy, etc.).
• It is truthful, based on real experiences and is not misleading or defamatory.
• It does not contain personal data of third parties without their consent.
• It does not have hidden advertising, promotional or commercial purposes.

License on published content

By publishing User Content on the website, the User grants the Owner a free, non-exclusive, worldwide and indefinite license (while it remains published) to reproduce, display, distribute and publicly communicate said content on the website and its associated channels (including social networks and the mobile application) for the purpose of providing the service.

Moderation and removal

The Owner reserves the right to review, moderate, edit or remove, without prior notice, any User Content that it considers to be in breach of these Terms, current legislation or good customs, without this generating any right to compensation in favour of the User. Likewise, the Owner may suspend or cancel the account of Users who repeatedly breach these Terms.

If a User detects inappropriate content, they can notify the Owner through the address info@turisonroad.com.

6. TurisOnRoad Card and other services

The TurisOnRoad Card and other services that the Owner may offer (Premium programs, subscriptions, promotions, etc.) shall be governed by their own specific conditions, which will be communicated at the time of contracting or membership and which the User must expressly accept.

These specific conditions complement these Terms and, in case of conflict, shall prevail over these regarding the specific service to which they refer.

7. Intellectual and industrial property

All the contents of the website (texts, images, photographs, videos, graphics, logos, brands, source code, design, navigation structure, databases, etc.) are the property of the Owner or of third parties who have authorised their use, and are protected by Spanish and international legislation on intellectual and industrial property.

The reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, of the contents of the website without the express and written authorisation of the Owner is expressly prohibited.

The User may view and print the contents of the website exclusively for personal and private use. Any other use will require the prior authorisation of the Owner.

8. Tourist information and exclusion of warranties

The Owner makes tourism information available to Users from various sources, including contributions from the Users themselves. This information is offered for guidance and informational purposes only.

The Owner does not guarantee the accuracy, validity, completeness or usefulness of the information published on the website, and assumes no responsibility for the decisions that the User may make based on said information. The User is recommended to verify the relevant data (schedules, prices, availability, access conditions, etc.) directly with the establishments or providers before planning a trip or visit.

The Owner is not responsible for the services, products, contents, opinions, conditions or any other aspect related to the establishments, accommodation, experiences, gas stations or other resources mentioned on the website, unless expressly indicated otherwise.

9. Links to third-party sites

The website may contain links to third-party websites. The Owner is not responsible for the content, privacy policies, practices or availability of said sites. Access to third-party sites is carried out under the sole responsibility of the User.

10. Service availability

The Owner will make every reasonable effort to keep the website operational, but does not guarantee uninterrupted availability or the absence of errors. The Owner may temporarily suspend the service for reasons of maintenance, updating or for reasons beyond its control, without this generating any right to compensation in favour of the User.

The Owner reserves the right to modify, suspend or discontinue, in whole or in part, the website or any of its services, at any time and without prior notice.

11. Limitation of liability

To the maximum extent permitted by law, the Owner shall not be liable for direct or indirect damages, including loss of profits, loss of data or any other damage arising from the use or inability to use the website, nor for the decisions adopted by the User based on the information obtained through it.

The foregoing does not limit or exclude the Owner's liability in those cases in which, according to applicable legislation, such limitation or exclusion is not possible.

12. Protection of personal data

The processing of personal data provided by the User is governed by the provisions of the Privacy Policy and the Cookie Policy of the website, which the User declares to know and accept.

13. Modification of the terms

The Owner reserves the right to modify these Terms at any time and without prior notice. The modifications will come into force from the moment of their publication on the website. Continued use of the website after the publication of the modifications will imply acceptance of them.

14. Termination

The Owner may suspend or cancel the User's access to the website, without prior notice and without right to compensation, in case of breach of these Terms, of current legislation or when legitimate reasons so advise.

15. Applicable legislation and jurisdiction

These Terms are governed by Spanish legislation. For the resolution of any dispute arising from the interpretation or execution of these Terms, the parties submit themselves to the Courts and Tribunals that correspond according to law.

In accordance with Regulation (EU) 524/2013, the User is informed that, in the event of being a consumer, they have at their disposal the European Union's online dispute resolution platform, accessible at: https://ec.europa.eu/consumers/odr.
